Magistrate Rebukes Takeaway Owners for Disruptive Court Behavior

A magistrate in Cessnock has reprimanded two takeaway shop owners for attempting to deliver what she characterized as “political speeches” during their court appearance on charges related to obstructing a council inspector. The incident took place on September 24, 2023, when Kim Chau and Robin To were summoned to the local court to address accusations stemming from an event at Aberdare Takeaway on June 26.

The charges against Chau and To include resisting or obstructing an authorized officer, as well as hindering a police officer in the execution of their duty. According to police reports, council staff and law enforcement had gone to the takeaway for a routine safety inspection but were allegedly denied entry. Police also stated that their officers faced assault during this encounter.

During the court proceedings, Magistrate Robyn Richardson asked Chau if she would prefer to seek an adjournment for legal advice or change her plea. Chau, however, attempted to read from a prepared statement. This prompted Ms. Richardson to instruct her not to speak over the court and threatened to leave the bench if she continued. Despite the warning, Chau persisted, leading to a brief departure by the magistrate as supporters from the gallery shouted “shame.”

Upon returning, Ms. Richardson reiterated her question about seeking an adjournment or changing the plea. Chau again tried to present her statement, resulting in further intervention from the magistrate. “I’m not going to have you give political speeches,” Ms. Richardson asserted, emphasizing her commitment to maintaining order in the courtroom.

The proceedings were ultimately adjourned until February 2026 for hearings, with Ms. Richardson instructing a sheriff to escort Chau and To out of the courtroom to prevent any further disruptions.

This incident underscores the tension between public service obligations and personal expressions of opinion, particularly in legal settings. The takeaway owners’ next court date will be closely monitored as the case progresses.
