UPDATE: A jury has just delivered a unanimous verdict in the trial of Michelle Anne Zutt, finding her guilty of causing the death of 23-year-old motorist Jakob Peck in a crash on the South Coast. The verdict was reached in a swift two-and-a-half hours, following a six-day trial that concluded on October 20, 2023.
The incident occurred on the afternoon of July 2, 2023, at the intersection of Princes Highway and Old Mossy Point Road in Bimbimbie. The court heard that Zutt rear-ended Peck’s vehicle, which was either at a standstill or nearly so, preparing to turn off the highway. Zutt hit him at a speed of approximately 100 km/h, sending Peck’s car crashing into another vehicle coming from the opposite direction, tragically leading to his death.
During closing arguments, Crown prosecutor Ciro Triscari emphasized the seriousness of Zutt’s driving behavior, stating that it constituted a “serious failure to properly manage and control the vehicle.” He noted, “You have to be paying attention, interpreting your environmental stimuli and reacting to it,” asserting that Zutt did not do so at the time of the crash.
In her defense, lawyer Brendan Green conceded that Zutt crashed into Peck’s vehicle but argued she was “driving like I always have, paying attention and in control of my car,” thereby contesting the claim of dangerous driving.
The jury’s decision was announced by Judge Miiko Kumar, who provided final instructions before they deliberated. After reaching their verdict, Zutt was allowed to leave the courtroom, as the Crown’s application for detention was denied. However, she is scheduled to return to Parramatta District Court on November 20, 2023, for sentencing.
