UPDATE: A former teacher from Bendigo has been sentenced to three years in prison for the historical rape of a 17-year-old student. Kirsten Thomas, aged 47, was convicted during a trial earlier this year, with the sentencing taking place on November 24, 2023.
The County Court heard shocking details of the incident that occurred after a graduation party in 2006. Thomas invited the victim to her home, where, during the night, the victim awoke to being sexually assaulted. Judge Michael McInerney noted that while the act was not a direct breach of trust, the victim held Thomas in “high esteem,” believing their relationship was platonic.
In his ruling, Judge McInerney expressed the profound impact of the crime, stating, “The pain of being abused by a trusted friend is marked.” He acknowledged that the trauma from such an experience “pervades and continues to pervade” the victim’s life. The judge emphasized the need for general deterrence, indicating the seriousness of the act despite it being categorized at the “lower end of seriousness.”
Thomas received an immediate 18 months of imprisonment, followed by an additional 18 months suspended sentence. She will also face reporting obligations for 15 years due to the nature of the offenses. Judge McInerney described Thomas’s actions as a dangerous practice, especially given her role as a recent class teacher and the potential consequences of having former students in her home after drinking.
