Court Fines Daniel Clark $3,000 for Serious Gun Safety Breach

UPDATE: In a significant ruling, Daniel William Clark, 49, has been fined $3,000 for multiple firearm offenses after a serious safety breach involving a young adult. The verdict was handed down at Batemans Bay Local Court on December 15, 2023, where Clark pleaded guilty to failing to secure a firearm and unlawfully transferring it to an unauthorized individual.

The court heard that the incident occurred in April 2023, during a time when Clark was living in Sydney but had a family history tied to a farm in Bodalla. According to his lawyer, Wayne Boom, the firearm was handed over in the garage of Clark’s former partner. It was only reported to authorities after their relationship ended, raising serious concerns about the handling of firearms.

Magistrate Doug Dick, who presided over the case, emphasized the gravity of the situation. He stated, “The courts can’t have a casual approach for firearms,” directly addressing Clark, who appeared in court wearing a dark blue suit. The judge highlighted that Clark had knowingly breached the Firearms Act by allowing the young adult to handle the firearm, which he admitted was not stored securely.

In a critical moment, Boom pointed out that Clark’s intention was not malicious but rather an attempt to let the young adult experience holding a firearm. “He wanted to let the person feel what a firearm was like,” Boom explained. However, he acknowledged that this rationale does not excuse the breach of safety regulations.

As a result of the court’s decision, Clark’s firearm license has been revoked, and the authorities have confiscated and destroyed the weapon involved in the incident. This ruling sends a strong message about the importance of firearm safety and compliance with legal regulations.
