Spain’s government has announced a significant policy shift that will provide legal status to potentially between 500,000 and 800,000 immigrants living and working in the country without authorization. This decision represents a departure from the increasingly restrictive immigration policies observed in many parts of the world, including the United States and other European nations.
Elma Saiz, Spain’s Minister of Migration, revealed the plan following a weekly cabinet meeting. She stated that the government will amend existing immigration laws through an expedited decree, allowing those living in Spain without authorization to obtain legal residency for up to one year, along with work permits. The new regulations will apply to individuals who arrived in Spain before December 31, 2025, and who can demonstrate they have lived in the country for at least five months. Additionally, applicants must show they have no criminal record.
“This day is historic,” Saiz remarked during a press conference, indicating the government’s commitment to addressing the needs of those who have been living on the fringes of Spanish society. This measure is expected to benefit a large number of individuals, many of whom are immigrants from Latin America and Africa working in essential sectors such as agriculture, tourism, and services, all of which are vital to Spain’s growing economy.
The expedited decree allows the government to bypass a stalled bill in parliament that aimed to achieve similar outcomes. Saiz anticipates that immigrants will be able to begin applying for legal status as early as April once the decree is implemented.
This unexpected move follows a last-minute agreement between the ruling Socialist Party and the left-wing Podemos party, which was forged to secure parliamentary support for Prime Minister Pedro Sánchez‘s government. The announcement has been met with enthusiasm from various migrant rights organizations and prominent Catholic groups, which had collected 700,000 signatures in support of a related initiative. This initiative had been admitted for debate in Congress in 2024 but faced challenges in garnering sufficient votes for passage.
