Applicant Ordered to Pay $330,000 for Failed Skywalk Lawsuit

URGENT UPDATE: The Land and Environment Court of New South Wales has delivered a significant ruling regarding the controversial Skywalk project, mandating that applicant Benjamin Hopkins pay a staggering $330,000 in legal costs to the Tamworth Regional Council. This decision comes after Hopkins lost his legal challenges against the council’s approval of the Skywalk, with judgment issued on September 26, 2025, and costs awarded on December 16, 2025.

The court’s ruling not only confirms the legality of the Skywalk project but also emphasizes the financial repercussions for those who challenge council decisions without legal representation. Justice Nicola Pain ordered Hopkins to cover the costs incurred from both lawsuits he initiated, alongside the costs determination process.

In a surprising twist, Hopkins requested an extension to this payment beyond the usual 28 days but failed to provide a specific timeframe. Justice Pain responded favorably, granting him a six-month period from the date of the orders before any payment obligations arise.

The Tamworth Regional Council disclosed in a business paper presented for its upcoming meeting that the total costs associated with defending against Hopkins’ litigation exceed $330,000, including approximately $250,000 in legal fees alone. The council highlighted that these legal battles divert critical resources from other projects, potentially impacting their outcomes.

Moreover, the council noted that police assistance was required during the proceedings due to safety concerns at the Skywalk site, illustrating the broader implications of the legal disputes on community safety and council operations.

Council members are set to vote on acknowledging the report titled “Skywalk Legal Case” in their February 24 meeting, a move anticipated to further clarify the implications of this ruling.
