UPDATE: A 70-year-old man, Michael Francis Martin, has been committed to stand trial for the rape of his grandmother, Jessie Grace Lauder, more than 40 years ago. The decision comes as a significant development in a case that has remained unresolved since the early 1980s.
In a hearing at the Melbourne Magistrates Court on Wednesday, Martin faced three charges related to the alleged rape, which reportedly occurred on July 6, 1983, at Lauder’s home in Newport, Melbourne. DNA evidence was deemed strong enough for a jury to consider whether Martin is guilty.
While Martin has been cleared of a second alleged rape of Lauder that took place in 1981 due to insufficient evidence, the magistrate acknowledged the severity of the charges against him. The court heard that Lauder, who passed away in 1993, would not be able to testify, complicating the case further.
Magistrate Rohan Lawrence described the alleged offenses as “most serious and certainly traumatic.” He noted that the prosecution’s arguments were compelling but ultimately not sufficient to link the two incidents definitively. The judge stated, “I do not believe there is a reasonable possibility that the Crown would be permitted to rely on coincidence reasoning to argue that the accused was responsible for the first offending.”
Martin has denied all allegations, pleading “not guilty” to each charge during the proceedings. His defense team pointed out significant differences between the two alleged incidents, arguing that the prosecution’s case lacked solid evidence, particularly for the earlier 1981 incident.
The prosecution highlighted 13 factors suggesting Martin’s involvement in both cases, including similarities in the circumstances of the attacks. However, Magistrate Lawrence found flaws in this reasoning, stating that the common features of the two alleged offenses were typical of numerous cases involving sexual assault by intruders.
As of now, Martin remains on trial bail and is scheduled for a directions hearing at the County Court on March 18. This case has reignited discussions about historical sexual offenses and the challenges in prosecuting cases where the primary witness is deceased.
