UPDATE: A man accused of violently attacking two prison guards in Tamworth has failed to appear in court, prompting serious concerns from the magistrate overseeing the case. Joshua Lee Murray, aged 25, was expected to appear in Tamworth Local Court today but did not show up, nor did he connect via video link from custody.
During the hearing, Magistrate Julie Soars expressed alarm over the absence of Murray, who is facing multiple serious charges, including two counts of assaulting a law officer and inflicting actual bodily harm. The alleged incidents occurred on September 10, 2023, between 2 PM and 2:20 PM at the Tamworth Correctional Centre. Reports indicate that Murray allegedly punched two corrections officers while they were performing their duties.
Ms. Soars emphasized the severity of the situation, describing the charges as “very serious” and noting that Murray had “bashed” the guards. In light of his absence, the magistrate ordered pleas of not guilty to be entered on his behalf for all charges.
The police prosecutor, Sergeant Brent Robinson, had expressed intentions to convict Murray in his absence, highlighting the urgency of the case. Following the court proceedings, Ms. Soars instructed a court officer to contact Murray’s solicitor from the Aboriginal Legal Service, Louis Gasparinatos, to ascertain the reasons for his non-appearance.
As the legal proceedings unfold, magistrate Soars has requested a brief of evidence to be submitted by February, with the matter set to return to court in March. Currently, Murray remains in custody as the case develops.
This incident raises critical questions about safety and security in correctional facilities, and the implications of such assaults on law enforcement personnel. The developing situation is being closely monitored, with further updates expected as the legal process continues.
