Sunbury Farmer Fined $10,175 for Burning Industrial Waste

UPDATE: A $10,175 fine has been imposed on Sunbury farmer Paul Attwell after authorities found illegal burning of industrial waste on his property. The Environmental Protection Authority Victoria (EPA) conducted an inspection in October in response to multiple community complaints regarding the troubling activities at Attwell’s Riddell Road farm.

The EPA’s investigation revealed that Active Farming, Attwell’s company, was not only burning industrial waste but also trucking it onto the farm. Following the discovery, the EPA issued an Environmental Action Notice mandating that the company cease all operations involving industrial waste immediately. Furthermore, Attwell is required to remove all such waste by January 30, 2024.

This urgent action comes after a recent ruling from the Victorian Civil and Administrative Tribunal (VCAT), which ordered an immediate halt to all activities at the property. The tribunal’s decision followed a lengthy investigation by Hume Council, which has been addressing ongoing concerns from residents about the significant disruption caused by the high volume of truck traffic entering the site—over 300 trucks per day.

Residents have voiced their frustration, reporting that the constant truck movements along Canterbury Avenue have severely impacted their daily lives. Many have taken their grievances to both the council and the EPA, seeking immediate intervention to stop the disruptions.

In a statement, the EPA emphasized that under the Environment Protection Act 2017 and the Infringements Act 2006, Attwell has the right to contest the infringement notice in court. This situation highlights the critical balance between agricultural practices and environmental protection, raising questions about regulatory enforcement in the region.

As the situation develops, residents and local officials are closely monitoring compliance with the tribunal’s orders. The upcoming deadline for waste removal is crucial, as any further violations could lead to additional legal action.
