UPDATE: A 42-year-old man from Tamworth has just dodged prison time following a court ruling on his backyard cannabis operation. Clinton James Barnes appeared before Magistrate Julie Soars at the Tamworth Local Court this week after pleading guilty to multiple charges, including cultivating a prohibited plant and possessing a prohibited weapon.
Authorities confirmed that Barnes was arrested on March 7, 2025, during a police search at his residence. Officers discovered 160 grams of cannabis and 13 cannabis plants being grown under lights in a makeshift tent. Additionally, they found a set of knuckle dusters, which Barnes admitted to purchasing online.
In a significant turn of events, the prosecution dropped a charge of supplying a prohibited drug after earlier negotiations. Barnes changed his plea from not guilty to guilty, indicating a willingness to accept responsibility for his actions.
During the hearing, Barnes’ solicitor, Wendy McAuliffe, highlighted her client’s history with drug-related issues, including a previous Intensive Correction Order in 2022. She emphasized that Barnes is a carer for a family member with serious health problems and argued that his cannabis cultivation was intended to assist with medicinal needs rather than for profit.
“While the operation wasn’t sophisticated, it was bound to attract police attention,” McAuliffe explained. She argued that the seriousness of the charges did not warrant a prison sentence, stating that Barnes had not crossed the threshold for incarceration.
Magistrate Soars ultimately agreed, issuing a 12-month Community Correction Order instead of jail time. Barnes is required to complete 40 hours of community service and undergo drug and alcohol counseling. “Be on good behavior for the next 12 months, and I hope not to see you here again,” Soars stated.
