UPDATE: The WA Government is set to implement urgent reforms for home building contracts, providing crucial protections for customers amidst rising concerns in the troubled industry. Proposed changes will ensure that home builds exceeding $500,000 offer consumers better support during contract disputes, with details to be unveiled early next year.
Commerce Minister Tony Buti has confirmed that statutory cooling-off periods are also under review as part of these critical reforms. This initiative aims to safeguard individuals making one of the largest financial commitments of their lives. Following a recent survey involving 568 consumers and 172 industry stakeholders, Mr. Buti emphasized the urgent need for enhancements in consumer protections.
Key survey findings revealed that many homeowners feel vulnerable, especially when disputes arise with builders. One respondent lamented, “We are not protected for our build over $500,000. We are basically left to stand on our own and to fight the builder with high legal costs.” This sentiment underscores the necessity for legislative changes to ensure better support for consumers navigating complex building contracts.
Feedback from both consumers and builders highlighted significant concerns regarding the low cap on contract sums eligible for regulatory assistance. Respondents called for improved clarity on rights and obligations, as well as a reevaluation of the current 45-day timeframe for obtaining building approvals. Builders noted that this period is often unrealistic due to varying processing times across local governments.
“Delays may occur that are outside both the builder’s and client’s control,” one builder stated, stressing the need for adjustments in the regulatory framework. The proposed reforms are also expected to facilitate early mediation by the Building Commissioner to resolve disputes effectively.
Mr. Buti expressed gratitude to all participants in the survey, stating, “These real-life experiences with home building contracts will help shape reforms that balance protections for homeowners and requirements for industry.” He confirmed that a Consultation Paper on the proposed reforms will be released early next year, inviting broader public input.
The urgency of these reforms comes on the heels of Mr. Buti’s July announcement regarding strengthened regulatory powers to investigate financially troubled builders. Legislation is being prepared to empower the Building Services Board and the Building Commissioner with enhanced authority to ensure better consumer protection.
