UPDATE: The court case against accused pedophile Joshua Dale Brown has been delayed as authorities seek more time to compile evidence. During a brief hearing at the Melbourne Magistrates Court on Tuesday, prosecutors successfully requested to extend his committal mention date to February 10, 2024, amidst ongoing investigations into his alleged crimes.
Brown, 26, faces a staggering 73 offences connected to the alleged abuse of eight children under two years old at the Creative Garden Early Learning Centre in Point Cook, Melbourne. The allegations span from April 2022 to January 2023. He first appeared in court on May 12, but the case remained suppressed until July 1, when Victoria Police publicly released the charges.
The delay was granted by Magistrate Donna Bakos, who acknowledged that detectives needed additional time to finalize their investigation. There is a possibility of more charges being laid against Brown in the coming weeks. Police are required to provide their brief of evidence to the defense by December 4.
Brown’s barrister, Rishi Nathwani KC, did not oppose the prosecution’s request but raised concerns about releasing charge sheets to the media, arguing that it was premature given the case’s high-profile nature. However, Magistrate Bakos emphasized the importance of public transparency, stating, “Fair and accurate reporting at this stage requires the nature of the charges to be released.”
The allegations against Brown include intentionally sexually touching a child on 13 separate occasions, producing and transmitting child abuse material, and engaging in sexual activity in the presence of children. He is also facing a separate charge related to contamination of goods intended to cause public alarm.
In a significant public health alert, Victorian authorities have advised the parents of approximately 2,000 children who may have interacted with Brown to seek testing for infectious diseases, following allegations that he contaminated food with bodily fluids.
Additionally, Brown’s co-accused, Michael Simon Wilson, 36, also did not appear in court on Tuesday. Prosecutors have extended his committal mention date to November 15, as detectives are given until October 4 to prepare their brief of evidence against him. Wilson faces serious charges, including rape and possessing child abuse material.
